BTMK Solicitors – Online Payment Terms and Conditions
- Our terms and conditions of accepting online payments are in addition to those stipulated by our card processing service provider.
- BTMK Solicitors Limited (including BTMK Todmans, BTMK Goodson and BTMK Marcus Baum) (collectively referred to as “BTMK”) can only accept online card payments on the following strict terms and conditions. Please note that any breach or deviation from these terms and conditions may require your payment to be returned or may delay your matter or transaction.
- Please read these terms and conditions carefully before using the online payment facility.
- By using the online payment facility, you are confirming acceptance of these Terms and Conditions. If you do not accept these Terms and Conditions, then please do not proceed with the online payment.
- All payments are subject to the following conditions: –
- Online payments can only be accepted if they are made by our client. If we receive payments from any third party on your behalf, the person dealing with your matter will need to follow certain procedures this firm has in place in order to ensure that we comply with anti-money laundering regulations. The person with conduct of your matter will need to obtain evidence of the third party’s identity. The source of any third party funds will also need to be verified and we shall also require the reason as to why the third party is paying on your behalf. We reserve the right to refuse payments which are not from you personally and the BTMK cannot accept any liability for any problems (e.g. time delays) that subsequently arise from us doing so. Where we refuse a third party payment, we may be bound by the regulations not to return the payment to the sender. It is usually better that you advise us in advance if a third party payment is to be accepted.
- All of the information requested on the payment page must be provided, and where references are required, you must provide the reference to us clearly so that we can identify the payment.
- Your payment will normally reach our account two days after you have paid. We cannot accept liability for any payment that does not reach the correct account due to you quoting the incorrect account number or personal details.
- We cannot accept liability where payment is refused or declined by the card provider for whatever reason.
- Should your provider decline payment, we are not obliged to bring this to your attention. You should check with your card provider that the payment has been processed through your account.
- The information that you provide during this transaction will be used solely for the purpose of recording your payment. We adhere to the requirements of all current Data Protection legislation in ensuring that the information provided is used for no other purposes and is disclosed to no third parties. - We will not be liable for any damages arising out of the use, inability to use, or the results of use of this site, any websites linked to this site, or the materials of information contained at any or all such sites, whether based on warranty, contract, tort or any other legal basis and whether or not we have been advised of the possibility of such damages.
- Refunds where applicable will only be made to the debit/credit card account used for the original transaction. Any refund will only be made after the funds have cleared into our account and any resulting refund can therefore take up to 10 working days.
- We will only accept payments for the following : (i) payments on account of costs of disbursements (i.e. payments we have requested from you but in advance of the work we are carrying out) (ii) payment of our invoices which can include our fees or disbursements. It is important that you understand that we do not and cannot accept online payments towards deposits, payments towards property transactions (including Stamp Duty Land Tax) and/or other damages awards.
- You agree by accepting these terms and conditions that you will not seek to make payment by card of any sums which are not payable in respect of the items at (14) above; attempting to do so will immediately entitle us to refund this payment (but does not oblige us to do so) and may delay the substantive transaction or legal matter;
- Online payments are subject to a maximum of £5000 (inclusive of any applicable VAT where indicated);
- If you have any difficulties or you need to make a payment for immediate or urgent use, please contact the person dealing with your matter or our accounts team at BTMK on 03300 585 222.
- Online payments can only be paid to us in GBP Sterling;
- Refunds requested for any other reasons, such as service dissatisfaction, will only be considered once BTMK’s official complaints procedure has been followed; if you are dissatisfied in any way, please speak to the person handling your matter in the first instance or contact 03300 585 222 and ask for the Complaints Director.Click here to accept these terms and conditions
